Jonah Flynn represented a group of nightclub workers who had been misclassified as “independent contractors” by their employer, resulting in substantial wage diversion and tip theft. Plaintiffs were nightclub employees who claim they were misclassified as independent contractors and were owed wages (including wages in the form of fees and tip-outs they were required to pay each shift), liquidated damages and attorneys’ fees for the period they were misclassified.
Forced tip-outs are illegal under Federal law, as are any fees imposed to work. Rather than face trial, the employer agreed to pay the claimants wage claims.
